Customisation

1.90 Any customisable features on bubblegumdirect.co.uk and associated websites are designed to be a representation. Bubblegum Direct reserve the right for the creative license over its products and will provide personalisation in the most effective way for the size, shape and layout of the chosen product. No refunds, discounts or compensation will be available for the personalisation style differing from that shown within the customise box or customer errors.

Delivery & Collection

2.00 Bubblegum Direct offer an All Day or a pre-2 pm delivery service via DPD on a next day service if the order is placed by 3.30pm.

2.01 If a collection is requested and the balloons are not picked up on the desired date, we are unable to provide a refund.  

Cancellation & Changes To Your Order

2.10 Bubblegum Direct will always try and be accommodating to changes to orders where possible. If you have any essential changes that need to be made to your order, we're able to accommodate these requests within an hour of the order being placed.

2.11 You may cancel a Contract at any time within 7 working days, beginning on the day after you receive the Goods. In this case, you will receive a full refund of the price paid for the Goods in accordance with our refunds policy. This right of cancellation does not apply to any Goods which are personalised or made to your specification.

2.12 To cancel a Contract, you must inform us by sending an email to hello@bubblegumdirect.co.uk. You must also return the Goods to us immediately, in the same condition in which you received them, and at your own cost and risk. You have a legal obligation to take reasonable care of the Goods while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

2.13 Details of how to exercise this right of cancellation are available upon request.

2.14 Nothing in this clause affects your statutory rights.

Exchanges, Refunds and Returns

2.20 When you return Goods to us in a re-saleable condition:

2.21 Because you cancelled the Contract in accordance with clause 2.10 (Cancellation & Changes to your Order), we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation. In this case, we will refund the price of the Goods to be returned in full, including the cost of sending the Goods to you. However, you will be responsible for the cost of returning the Goods to us;

2.22 For any other reason, we will examine the returned Goods and will notify you via e-mail within a reasonable time of any refund to which you are entitled. We will usually process the refund as soon as possible thereafter.

2.23 We will normally refund any money received from you by bank transfer. You will need to provide your bank account number and sort code. If you paid via credit or debit card, we will refund the same card originally used to pay for your purchase.

Data Protection

2.30 We are unable to discuss orders of any nature with the recipient of the items if they are not billable customers. For any queries regarding the order you've received, please have the billable customer get in contact with us.

2.31 We may process your personal information for our legitimate business interests. ‘Legitimate Interests’ means the interests of our company in conducting and managing our business to enable us to give you the best service/products and the best and most secure experience. It can and does also apply to processing which is in your interest too. Processing for our legitimate interests may include processing for the purposes of (i) fraud prevention and compliance; (ii) certain direct marketing and promotional activities; (iii) the provision and operation of referral marketing programmes; (iv) network and information systems security; (v) data analytics; (vi) enhancing, modifying or improving our service; (vii) identifying usage trends, or (viii) determining the effectiveness of promotional campaigns or advertising. In connection with the above activities, we may share your personal information with trusted suppliers who assist us in our data processing activities. Bubblegum Direct does not sell customer information or data to any third party supplier. Our legitimate business interests do not automatically override your interests - we will not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted by law). Law and Jurisdiction

These terms and conditions are governed by English law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
